Bankruptcy Means Test Lawyer in Macon, Georgia

One of the major benefits of a Chapter 7 bankruptcy filing is the ability to completely discharge certain unsecured debt. This includes credit card debt, medical bills and other personal debt that you may have incurred. In order to file for Chapter 7 bankruptcy, the debtor must first qualify under a bankruptcy “means test.” Unfortunately, recent changes in federal bankruptcy laws have made it more difficult to qualify for Chapter 7 bankruptcy under the means test.

Helping You Understand Your Bankruptcy Options

That is why it is so important that you have a skilled and experienced Chapter 7 bankruptcy attorney who can go over your financial situation and determine whether bankruptcy is right for you. You may be a good candidate for Chapter 7 bankruptcy or you may find out that your situation is better suited for Chapter 13 bankruptcy. Either way, there are more options out there for you that your bankruptcy lawyer can help you select through an informed decision-making process.

With over two decades of experience, our Macon, Georgia, bankruptcy lawyer is seasoned when it comes to representing bankruptcy clients. Contact us today at The Law Firm of Stacey Nestor, PC, to schedule your free initial consultation.

The Bankruptcy Means Test

After bankruptcy reform laws were passed by the Congress in 2005, it became harder for debtors to qualify for Chapter 7 bankruptcy. That is because requirements were tightened under the bankruptcy means test. In general terms, the bankruptcy means test looks at your gross household income the past six months prior to filing. This number is compared to the median household income for others across Georgia (households that have the same number of dependents). If you are higher than the median household income for your family’s size, then you are not likely to have passed the means test, and it may appear that you do not qualify for Chapter 7 bankruptcy. However, a skilled bankruptcy attorney is sometimes able to successfully adjust your income based on certain factors. Without an experienced attorney,
many times individuals incorrectly determine they are not eligible to file a Chapter 7 bankruptcy.

However, this is just a general summary of the means test. It is critical that you talk to our skilled bankruptcy attorney to determine how your specific situation applies to the rule, as every financial case is unique.
